The Difference between a Statutory Declaration and an Affidavit

Your Filipino lawyer understands the varied legal documents that you may need. A Statutory Declaration and an Affidavit are not the same, and even though they are sometimes referred to interchangeably, each has a different use.

Statutory Declarations and Affidavits must both be completed and signed in compliance with a set of procedures laid down in the law. A notary public will plan and assist you in the execution of all forms of documents.


WHAT IS A STATUTORY DECLARATION?

A statutory declaration is usually utilized outside of a court setting, but generally has the same effects as a sworn affidavit. The declaration is a statement of facts that a person says is true. A notary public can certify that the person signing the document is the person he or she purports to be. Witnesses to the fact that the document was signed by the person indicated therein usually signs these documents. The individual who is making a declaration is called the “declarant.”

WHAT IS AN AFFIDAVIT?

A sworn affidavit contains facts that are written in a particular document and the affiant swears that the contents are all true before an individual that is authorized to administer the oaths.

An “affiant” is the individual swearing to the statement being made.

WHEN ARE AFFIDAVITS USED?

There are different uses of different kinds of affidavits which may include the following:

  • Presentation of evidence in some forms of proceedings in the course of a civil case
  • Usually only written evidence (including affidavits) is sent to the court when the decision of the court is appealed
  • Determination of the issue of assessment of damages or of the value of goods in a civil case
