Domestic abuse may be committed against or by anyone regardless of age, race, economic status, religion, sexual orientation or education. While men may encounter domestic abuse, women are mostly affected in overwhelming proportions. Domestic abuse is frequently listed as one of Canada’s most prevalent forms of violence against women.

The Criminal Code does not include a particular offence of family violence in Canada. Yet, related criminal offences can range from physical and sexual violence to the administration of justice. Examples of this is one’s failure to comply with a restraining order, neglect and abandonment, criminal negligence, financial abuse, and psychological or emotional abuse.

A conviction of domestic abuse or domestic assault can lead to imprisonment or a criminal record, leading to potential life difficulties involving the inability to land a job, not being able to travel or enter certain jurisdictions, and perhaps most importantly, not being able to see or play an active role in your children’s lives.

Domestic violence is a major issue around the world, and many non-profit organizations work tirelessly to provide support and services to the victims. Do you know what you should do when you are charged with domestic assault or violence? Today, domestic assault is not only considered a crime but also treated as one. In Canada, domestic assault is a serious offence and is one of the most commonly accused crimes in Toronto. Assault combines the threat of violence with the perceived capacity to inflict injury.

What are the penalties for Domestic Assault?

Under the Criminal Code of Canada, a domestic assault charge could lead to a prison sentence of up to 5 years.

Here are some of the things you should do if you have been charged with domestic assault:

  • Comply with all your bail conditions.
  • Make a personal record of your recollection of the allegations made against you. If the events relating to the allegation are false, then make a record of where you were and what you were doing at the time of the incident.
  • Do not accept any resolution offered by the Crown Attorney or enter into a guilty plea for an offence you did not commit. You should receive your disclosure on the first court date and review it with a Filipino criminal defence lawyer so that you understand what your legal options are.
