Misrepresentation happens when information that is contradictory, incorrect, or incomplete is given to Immigration, Refugees and Citizenship Canada (IRCC) or to the Canada Border Services Agency (CBSA). It is becoming more common to be held inadmissible to Canada due to misrepresentation. This is a very serious problem as it results to a five-year moratorium on making an application to return to Canada. This means that for the next 5 years, you will not be eligible to join Canada.

The following are examples of misrepresentations:


  • Submitting a document that is found to be counterfeit or fake
  • Failure to declare a family member
  • Being in a non-genuine marriage
  • False declaration of work experience
  • Reversing the date and month of birth on an application
  • Indicating being single when in fact you were widowed

Being sponsored by an individual found guilty of making a misrepresentation, a claimant, a family member, or your representative may provide or otherwise not provide the misrepresented data. In both circumstances, even though they did not know that there was a misrepresentation, it is the principal applicant who is to be deemed at fault.

Findings of misrepresentation will have a huge effect on your immigration status in Canada. If you and any or all of your dependent family members (spouse and child/ren) are found to have committed misrepresentation, you and any and all your dependent family members (spouse and child/ren) will all be found inadmissible to Canada, prohibiting you from receiving another temporary or permanent resident visa.
