HOW A FILIPINO LAWYER CAN HELP YOU UNDERSTAND CHILD CUSTODY, VISITATION AND ACCESS

Custody means having the legal right and duty to make all the significant decisions about the life of the child. This involves decisions regarding school, religion, medical decisions and other important matters relating to the child.
When one parent gets the custody of the child, the other parent usually requests to get access, which means that he/she has the right to visit and spend time with the child, know how well the child is doing in school, and also know about the child’s health.

These are the 2 primary types of Custody arrangements:

1. Sole Custody

Once granted sole custody, you will make important decisions about things like the welfare of your child regarding health, schooling, and religious instruction on your own. This type of custody is the most common arrangement in family cases.

2. Joint Custody

If you have joint custody, you and the other parent of the child both have the right to make important choices regarding the life of the child, which obliges both parents to work together. The Court is less likely to order joint custody if the Court knows that the parents do not get along, or if there is or has been violence.

There are also various Types of Access:

  • Reasonable Access,
  • Fixed or Limited Access,
  • Graduated Access,
  • Supervised Access, and
  • No Access.

It is important to remember that as a parent provided with access, you are not given the authority to make any major decisions about your child’s upbringing. The custodial parent will make the final decision if a dispute occurs between you and your former spouse. However, prior to making any final decisions on significant matters with regards to the child, the custodial parent in must also consult with the access parent.

How can a Filipino Lawyer help you with the Decision about Custody and Access?

Only the best interests of the child must be considered when the Court makes a decision on custody and access. This is a legal consideration that is strictly observed by the Courts. Some of the things that the Court is going to look for are:

  • What plans does each parent have for the care and education of the child?
  • How gentle and loving is the relationship between the child and each parent?
  • The court determines whether which parent is unfit for protecting the child or taking care of the child.
  • Other considerations about how you treat the child and which parent does the child feel more comfortable living with.
